1. Agreement to Terms

By accessing or using ByteRange ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and ByteRange.

2. Description of Service

ByteRange is a cybersecurity training, skill verification, and talent matching platform. The Platform provides:

• Hands-on security challenges based on real-world vulnerabilities and CVEs
• Docker-based sandboxed environments for hands-on practice
• Structured career paths for cybersecurity role preparation
• Skill verification and ranking through challenge completion
• Job matching connecting verified candidates with employers
• Company accounts for posting positions and discovering talent

3. User Accounts

To access certain features of the Platform, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Be at least 16 years of age
• Maintain the confidentiality of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that contain false information or violate these Terms.

4. Account Types

The Platform supports the following account types:

• Candidate accounts: For individuals solving challenges, building skill profiles, and applying for positions
• Company accounts: For organizations posting job positions, browsing verified candidates, and managing hiring pipelines
• Creator accounts: For approved content creators who submit challenges to the Platform (coming soon)
• Validator accounts: For authorized reviewers who assess challenge writeups and solutions

5. Acceptable Use

You agree NOT to:

• Share challenge solutions, flags, or detailed walkthrough content with unauthorized parties
• Attempt to access other users' accounts or private data
• Use automated tools, bots, or scripts to solve challenges or scrape content
• Attack, probe, or attempt to compromise the Platform's infrastructure
• Use skills or techniques learned on the Platform for malicious or illegal purposes
• Misrepresent your identity, qualifications, or challenge completions
• Engage in any activity that violates applicable laws or regulations
• Circumvent or manipulate the ranking, scoring, or verification systems
• Upload malicious content, malware, or exploit code targeting the Platform itself
• Harass, threaten, or abuse other users of the Platform

6. Challenge Guidelines

All challenges on the Platform are designed for educational purposes within sandboxed environments. By using the Platform, you acknowledge and agree that:

• Techniques learned should only be applied ethically and with proper authorization
• Attacking systems without explicit authorization is illegal and violates these Terms
• Challenge solutions and writeups you submit become part of your verified profile
• Writeups may be reviewed by validators and, where applicable, AI systems for quality assessment
• You retain authorship of your writeups but grant ByteRange a license to display them in the context of skill verification

7. Skill Verification and Profiles

Your skill profile is built from challenges you complete and writeups you submit. Regarding skill verification:

• Skill scores are determined by challenge difficulty, quality of writeups, and validator assessments
• Your public profile may be visible to companies using the Platform for hiring
• You can control your profile visibility and what information employers can see in your privacy settings
• ByteRange does not guarantee employment outcomes based on skill verification
• We reserve the right to revoke skill verifications if fraud or cheating is detected

8. Company Accounts and Job Postings

Companies using the Platform agree to the following additional terms:

• Job postings must be for legitimate, currently open positions
• Company information and job descriptions must be accurate and not misleading
• Companies must not contact candidates for purposes unrelated to legitimate hiring
• Candidate data obtained through the Platform must be handled in accordance with applicable data protection laws
• Companies must not discriminate against candidates based on protected characteristics

9. Payments and Credits

Certain features of the Platform may require payment or credits:

• Payments are processed through our third-party payment provider (Stripe)
• All prices are displayed inclusive of applicable taxes unless stated otherwise
• Credits purchased are non-transferable and non-refundable unless required by law
• We reserve the right to modify pricing with reasonable notice to users
• Refunds may be granted at our discretion for technical issues preventing service delivery

10. Intellectual Property

Intellectual property on the Platform is governed as follows:

• Platform content: All challenges, learning materials, branding, and software are owned by ByteRange or its licensors. You may not copy, distribute, or create derivative works without written permission.
• User content: You retain ownership of writeups and solutions you submit. By submitting content, you grant ByteRange a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Platform's services.
• Third-party content: Some challenges reference real-world CVEs and use open-source tools. Such content is used under their respective licenses and attributed accordingly.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure. We do not guarantee any specific outcomes from using the Platform, including employment or hiring results. Challenge environments are provided for educational purposes and may not perfectly replicate production systems.

12. Limitation of Liability

To the maximum extent permitted by law, ByteRange and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

13. Termination

We may terminate or suspend your account and access to the Platform:

• Immediately, without prior notice, for violations of these Terms
• For any reason, with reasonable notice, at our sole discretion
• Upon your request through your account settings or by contacting us

Upon termination, your right to use the Platform ceases immediately. You may request export of your data prior to termination. We may retain certain data as required by law or for legitimate business purposes.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 14 days before they take effect. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable member state. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Europe.
